Article LO6352-12 of the French General Code of Local Authorities

The decision of the Territorial Council or the Executive Council instructing the President of the Territorial Council to award a specific contract may be taken before the award procedure is initiated. In this case, it must include a definition of the scope of the need to be met and the estimated value of the contract.

The Territorial Council may, at any time, decide that the contract may only be signed after a new deliberation, once the identity of the successful tenderer and the amount of the contract are known.

The provisions of this article do not apply to the contracts referred to in article LO 6352-11 than when the President of the Territorial Council has not received the delegation provided for in the same article.

La délibération du conseil territorial ou du conseil exécutif chargeant le président du conseil territorial de souscrire un marché déterminé peut être prise avant l’engagement de la procédure de passation de ce marché. Elle comporte alors obligatoirement la définition de l’étendue du besoin à satisfaire et le montant prévisionnel du marché.

Le conseil territorial peut, à tout moment, décider que la signature du marché ne pourra intervenir qu’après une nouvelle délibération, une fois connus l’identité de l’attributaire et le montant du marché.

Les dispositions du présent article ne s’appliquent aux marchés visés à l’article LO 6352-11 que lorsque le président du conseil territorial n’a pas reçu la délégation prévue au même article.
