Article LO6352-14 of the French General Code of Local Authorities

The president of the territorial council may, after deliberation by the executive council, refer to the administrative court a request for an opinion on the interpretation of the status of Saint-Martin or on the applicability in the collectivity of a legislative or regulatory text.

In the event of serious difficulty, the president of the administrative court may refer this request to the Conseil d’Etat.

When the request for an opinion relates to the division of powers between the State and the local authority, it is examined by the Conseil d’Etat, to which it is referred without delay. The State representative is informed immediately.

Le président du conseil territorial peut, après délibération du conseil exécutif, saisir le tribunal administratif d’une demande d’avis portant sur l’interprétation du statut de Saint-Martin ou sur l’applicabilité dans la collectivité d’un texte législatif ou réglementaire.

En cas de difficulté sérieuse, le président du tribunal administratif peut transmettre cette demande au Conseil d’Etat.

Lorsque la demande d’avis porte sur la répartition des compétences entre l’Etat et la collectivité, elle est examinée par le Conseil d’Etat auquel elle est transmise sans délai. Le représentant de l’Etat en est immédiatement informé.
