Article R. 1435-15-1 of the French Public Health Code

Before concluding a contract for the purpose of carrying out the tasks of monitoring the collection of healthcare quality and safety indicators referred to in the second paragraph of Article L. 1435-7, the Director General of the Regional Health Agency shall check that the applicant satisfies the conditions laid down in Article L. 4111-1 and in 2° and 3° of Article R. 1435-12.

The performance of the aforementioned tasks by doctors who have signed a contract with the Regional Health Agency is subject to the completion of at least seven hours of technical and legal training in the monitoring of the collection of quality and safety indicators, provided jointly by the Ministry of Health and the High Authority for Health.

Prior to each assignment, the Director General of the Regional Health Agency verifies, in the light of the declaration of interests provided for by the provisions of article L. 1451-1, that there are no conflicts of interest that would prevent the doctor from carrying out his assignment in the establishment concerned.

Article R. 1435-15-1

Préalablement à la conclusion d’un contrat ayant pour objet l’accomplissement des missions de contrôle du recueil des indicateurs de qualité et de sécurité des soins mentionnées au deuxième alinéa de l’article L. 1435-7, le directeur général de l’agence régionale de santé vérifie que le candidat satisfait aux conditions prévues à l’article L. 4111-1 et aux 2° et 3° de l’article R. 1435-12.

L’accomplissement des missions précitées par les médecins ayant conclu un contrat avec l’agence régionale de santé est subordonné au suivi d’une formation technique et juridique au contrôle du recueil des indicateurs de qualité et de sécurité des soins d’au moins sept heures, dispensée conjointement par le ministère chargé de la santé et la Haute Autorité de santé.

Préalablement à chaque mission, le directeur général de l’agence régionale de santé vérifie, au regard de la déclaration d’intérêts prévue par les dispositions de l’article L. 1451-1, l’absence de conflits d’intérêts faisant obstacle à l’accomplissement de sa mission par le médecin auprès de l’établissement concerné.
