Article R11 of the French Code of Criminal Procedure

The following shall not be considered as giving rise to an initial assignment within the meaning of the penultimate paragraph of article 16, the stages of the curriculum during which the gendarmerie officers referred to in 2° of the same article benefit, for the purposes and as part of their initial and additional training, from the status of judicial police officer. In this case, an authorisation is issued for the entire duration of the course by the public prosecutor at the court of appeal within whose jurisdiction the training centre is located and ends at the end of the course.

By way of derogation from the previous paragraph, students admitted to the Gendarmerie Officer Training School under Decree no. 2008-946 of 12 September 2008 on the special status of the Gendarmerie officer corps who have judicial police officer authorisation retain the benefit of this authorisation during their initial and additional training and at the end of their schooling.

Ne sont pas considérées comme donnant lieu à une première affectation au sens de l’avant-dernier alinéa de l’article 16, les étapes du cursus au cours desquelles les officiers de gendarmerie mentionnés au 2° du même article bénéficient, pour les besoins et dans le cadre de leur formation initiale et complémentaire, de la qualité d’officier de police judiciaire. Dans ce cas, une habilitation est délivrée pour toute la durée de la scolarité par le procureur général près la cour d’appel dans le ressort de laquelle est implanté le lieu de formation et prend fin à l’issue de celle-ci.

Par dérogation au précédent alinéa, les élèves admis à l’Ecole des officiers de la gendarmerie au titre du décret n° 2008-946 du 12 septembre 2008 portant statut particulier du corps des officiers de gendarmerie qui disposent d’une habilitation d’officier de police judiciaire conservent le bénéfice de cette habilitation pendant leur formation initiale et complémentaire et à l’issue de leur scolarité.
