Article R1112-4 of the French Public Health Code

In the event that the practitioner who prescribed the hospitalisation requests communication of the file, this communication may only take place with the agreement of the patient, the person with parental authority or the person in charge of the legal protection measure with representation relating to the person when the person concerned is not capable of expressing his/her wishes. Except in emergencies, in the event of disagreement between the protected adult and the person responsible for his or her protection, the judge will authorise either of them to make the decision, at their request or ex officio. In the event of the patient’s death, the agreement is given by his or her heirs.

Dans le cas où le praticien qui a prescrit l’hospitalisation demande communication du dossier, cette communication ne peut intervenir qu’après accord du patient, de la personne ayant l’autorité parentale ou de la personne chargée de la mesure de protection juridique avec représentation relative à la personne lorsque l’intéressé n’est pas apte à exprimer sa volonté. Sauf urgence, en cas de désaccord entre le majeur protégé et la personne chargée de sa protection, le juge autorise l’un ou l’autre à prendre la décision, à leur demande ou d’office. En cas de décès du patient, l’accord est donné par ses ayants droit.
