Article R1116-5 of the French General Code of Local Authorities

When the definitively adopted act is transmitted to the representative of the State or, where applicable, to the delegate in the district of the representative of the State in the department, as part of the exercise of legality control, the author of the request for a formal position statement attaches the formal position statement to the act transmitted.

Lors de la transmission de l’acte définitivement adopté au représentant de l’Etat ou, le cas échéant, au délégué dans l’arrondissement du représentant de l’Etat dans le département, dans le cadre de l’exercice du contrôle de légalité, l’auteur de la demande de prise de position formelle joint à l’acte transmis la prise de position formelle.
