Article R1123-25 of the French Public Health Code

Within one month of being notified of the committee’s unfavourable opinion, the sponsor may use the information system for research involving the human person to request that his dossier be re-examined by another committee. The sponsor must inform the competent authority. Such a request may only be made once. The newly appointed committee will examine the request under the conditions laid down in article R. 1123-23. A member of the committee which issued the unfavourable opinion may not sit on the committee which re-examines the application.

Dans le délai d’un mois suivant la notification de l’avis défavorable du comité, le promoteur peut effectuer sur le système d’information des recherches impliquant la personne humaine une demande de réexamen de son dossier par un autre comité. Il en informe l’autorité compétente. Une telle demande ne peut être faite qu’une seule fois. Le nouveau comité désigné instruit la demande dans les conditions prévues par l’article R. 1123-23. Un membre du comité qui a rendu l’avis défavorable ne peut siéger dans le comité qui réexamine le dossier.
