Article R114-37 of the French Sports Code

At the end of each financial year, the accounting officer in office prepares the centre’s financial account for the previous financial year.

The financial account is endorsed by the authorising officer, who certifies that the amounts of expenditure orders and revenue orders are consistent with his records.

Before the end of the fourth month following the end of the financial year, the Board of Directors approves the financial account after hearing the Accounting Officer.

The financial account, together with any comments from the Board of Directors and the accounting officer, is sent by the director of the centre to the president of the regional council and the rector of the academic region within thirty days of its adoption. The financial account is also sent to the Minister for Sport for information within the same timeframe. The President of the Regional Council shall forward it to the elected regional representatives who request it in accordance with the conditions set out in article L. 4132-17 of the General Local Authorities Code.

The accounting officer produces the financial account and related documents by the end of the sixth month following the end of the financial year, in accordance with the procedures laid down by order of the Minister responsible for the budget.

The centre shall ensure that the supporting documents are kept for the period during which the public manager may be held liable.

A la fin de chaque exercice, l’agent comptable en fonction prépare le compte financier du centre pour l’exercice écoulé.

Le compte financier est visé par l’ordonnateur qui certifie que le montant des ordres de dépenses et des ordres de recettes est conforme à ses écritures.

Avant l’expiration du quatrième mois suivant la clôture de l’exercice, le conseil d’administration arrête le compte financier après avoir entendu l’agent comptable.

Le compte financier, accompagné éventuellement des observations du conseil d’administration et de celles de l’agent comptable, est transmis par le directeur du centre au président du conseil régional et au recteur de région académique dans les trente jours suivant son adoption. Le compte financier est également transmis dans les mêmes délais au ministre chargé des sports pour information. Il est communiqué par le président du conseil régional aux élus régionaux qui en font la demande dans les conditions prévues à l’article L. 4132-17 du code général des collectivités territoriales.

L’agent comptable produit, selon des modalités fixées par arrêté du ministre chargé du budget, le compte financier et les pièces annexes au plus tard à l’expiration du sixième mois suivant la clôture de l’exercice.

Le centre s’assure de la conservation des pièces justificatives pendant la période au cours de laquelle la responsabilité du gestionnaire public est susceptible d’être engagée.
