Article R1142-63-16 of the French Public Health Code

When the condition of the person who has suffered damage has been consolidated after the date on which the college issued its first opinion, or when new damage attributable to a worsening of the person’s condition requires a new assessment of the damage, this person or his beneficiaries may ask the college of experts to issue a new opinion.

The claim is investigated under the conditions set out in articles R. 1142-63-7 to R. 1142-63-14, without however the need to investigate again whether the claimant can prove a functional deficit attributable to benfluorex.

Article R1142-63-16

Lorsque la consolidation de l’état de la personne ayant subi des dommages est postérieure à la date à laquelle le collège a rendu un premier avis ou lorsque des préjudices nouveaux imputables à une aggravation de l’état de la personne nécessitent une nouvelle évaluation des dommages, cette personne ou ses ayants droit peuvent demander au collège d’experts d’émettre un nouvel avis.

La demande est instruite dans les conditions prévues aux articles R. 1142-63-7 à R. 1142-63-14, sans qu’il y ait toutefois lieu de rechercher à nouveau si le demandeur justifie d’un déficit fonctionnel imputable au benfluorex.
