Article R1161-4 of the French Public Health Code

I. – The declaration of a patient therapeutic education programme, referred to in article L. 1161-2, is sent, by any means which provides a date certain of its receipt, to the director general of the regional health agency within whose territorial jurisdiction the therapeutic education programme is to be implemented.

Where the programme falls within the territorial jurisdiction of several regional health agencies, the declaration file is sent by the programme coordinator to the director general of each regional health agency.

This file includes information relating to

1° The objectives of the programme and how it is organised ;

2° The number and qualifications of the coordinator and staff involved in the programme;

3° The population concerned by the programme;

4° The projected sources of funding.

5° Compliance with the obligations set out in articles L. 1161-1 to L. 1161-4 and R. 1161-3.

The composition of the declaration file is set by order of the Minister for Health.

II – The application is deemed to be complete if the Director General of the Regional Health Agency has issued an acknowledgement of receipt by any means giving a definite date of receipt or has not informed the applicant, by any means giving a definite date of receipt of this information, within two months of receipt of the application, of the list of missing or incomplete documents.

The declaration takes effect from the date on which the application is deemed to be complete.

III – Termination of the programme must be notified to the Director General of the Regional Health Agency, or to all the Directors General if the programme concerns several regions, within three months of it taking effect.

Article R1161-4

I. ― La déclaration d’un programme d’éducation thérapeutique du patient, mentionnée à l’article L. 1161-2, est adressée, par tout moyen donnant date certaine à sa réception, au directeur général de l’agence régionale de santé dans le ressort territorial de laquelle le programme d’éducation thérapeutique est destiné à être mis en œuvre.

Lorsque le programme relève de la compétence territoriale de plusieurs agences régionales de santé, le dossier de déclaration est adressé par le coordonnateur du programme au directeur général de chaque agence régionale de santé.

Ce dossier comprend des informations relatives :

1° Aux objectifs du programme et à ses modalités d’organisation ;

2° Aux effectifs et à la qualification du coordonnateur et des personnels intervenant dans le programme ;

3° A la population concernée par le programme ;

4° Aux sources prévisionnelles de financement.

5° Au respect des obligations mentionnées aux articles L. 1161-1 à L. 1161-4 et R. 1161-3.

La composition du dossier de déclaration est fixée par arrêté du ministre chargé de la santé.

II. ― Le dossier est réputé complet si le directeur général de l’agence régionale de santé a délivré un accusé de réception par tout moyen donnant date certaine à sa réception ou n’a pas fait connaître au déclarant, par tout moyen donnant date certaine à la réception de cette information, dans le délai de deux mois à compter de la réception du dossier, la liste des pièces manquantes ou incomplètes.

La déclaration prend effet à compter de la date à laquelle le dossier est réputé complet.

III. ― La cessation du programme est déclarée au directeur général de l’agence régionale de santé, ou à l’ensemble des directeurs généraux si le programme concerne plusieurs régions, dans un délai de trois mois à compter de sa prise d’effet.
