In the event that the premiums mentioned in article L. 121-19 are made up of objects distributed with the aim of meeting environmental requirements, these objects are fully recyclable, whether they are fireproof recyclable cardboard or food-safe inks.
If these objects belong to the category of products and ingredients, respectively defined in articles L. 3512-1 and L. 3512-2 of the Public Health Code, they do not include any reference, graphics, presentation or any other distinctive sign reminiscent of a product or ingredient, as defined in this same article. In this case, health warnings relating to the dangers of tobacco must be mentioned.
The references of the person interested in the advertising operation, the name of the brand, acronym or logo may be affixed to objects as long as they comply with the provisions restricting or framing advertising concerning alcohol, tobacco and online gambling or betting, in particular provided for in Articles L. 3512-4, L. 3512-5 and L. 3323-2 to L. 3323-5 of the Public Health Code.
