Article R121-1 of the French Consumer Code

In the event that the premiums mentioned in article L. 121-19 are made up of objects distributed with the aim of meeting environmental requirements, these objects are fully recyclable, whether they are fireproof recyclable cardboard or food-safe inks.

If these objects belong to the category of products and ingredients, respectively defined in articles L. 3512-1 and L. 3512-2 of the Public Health Code, they do not include any reference, graphics, presentation or any other distinctive sign reminiscent of a product or ingredient, as defined in this same article. In this case, health warnings relating to the dangers of tobacco must be mentioned.

The references of the person interested in the advertising operation, the name of the brand, acronym or logo may be affixed to objects as long as they comply with the provisions restricting or framing advertising concerning alcohol, tobacco and online gambling or betting, in particular provided for in Articles L. 3512-4, L. 3512-5 and L. 3323-2 to L. 3323-5 of the Public Health Code.

Dans le cas où les primes mentionnées à l’article L. 121-19 sont constituées d’objets distribués dans le but de satisfaire à des exigences environnementales, ces objets sont entièrement recyclables, qu’il s’agisse de carton recyclable ignifugé ou d’encres alimentaires.

Si ces objets appartiennent à la catégorie de produits et ingrédients, respectivement définis aux articles L. 3512-1 et L. 3512-2 du code de la santé publique, ils ne comportent aucune référence, graphisme, présentation ou tout autre signe distinctif qui rappelle un produit ou un ingrédient, défini à ce même article. Dans ce cas, les avertissements sanitaires relatifs aux dangers du tabac doivent être mentionnés.

Les références de la personne intéressée à l’opération de publicité, la dénomination de la marque, du sigle ou logo peuvent être apposées sur les objets pour autant qu’elles respectent les dispositions restreignant ou encadrant la publicité concernant l’alcool, le tabac et les jeux ou paris en ligne, notamment prévues aux articles L. 3512-4, L. 3512-5 et L. 3323-2 à L. 3323-5 du code de la santé publique.
