Article R121-5 of the French Commercial code

The single body mentioned in article R. 123-1 receives, under the conditions laid down in this book:

1° In the single declaration file for setting up the business, where applicable, the declaration of the regular professional activity in the business of the spouse of the head of the business and the status chosen by this spouse, pursuant to I of article L. 121-4, accompanied by a sworn statement signed by the spouse confirming the choice of this status;

2° Where applicable, and within two months of the change in the company’s situation:

a) The amending declaration stating that the spouse of the company director has a regular professional activity in the company and the status chosen by this spouse in application of I of article L. 121-4, accompanied by a sworn statement signed by the spouse confirming the choice of this status;

b) The amending declaration stating that the spouse of the company director who carries out a regular professional activity in the company changes status in order to carry out this activity, accompanied by a sworn statement signed by the spouse confirming the choice of this new status;

c) The amending declaration stating that the spouse of the company director ceases to fulfil the conditions provided for in I of article L. 121-4.

The format of the attestation on honour mentioned in this article and the information it contains are determined by order of the ministers responsible for the economy, justice and social affairs.

Article R121-5

L’organisme unique mentionné à l’article R. 123-1 reçoit, dans les conditions prévues par le présent livre :

1° Dans le dossier unique de déclaration de création de l’entreprise, le cas échéant, la déclaration de l’activité professionnelle régulière dans l’entreprise du conjoint du chef d’entreprise et du statut choisi par ce conjoint, en application du I de l’article L. 121-4, accompagnée d’une attestation sur l’honneur signée du conjoint confirmant le choix de ce statut ;

2° Le cas échéant et dans les deux mois suivant la modification de la situation de l’entreprise :

a) La déclaration modificative portant mention que le conjoint du chef d’entreprise exerce une activité professionnelle régulière dans l’entreprise et du statut choisi par ce conjoint en application du I de l’article L. 121-4, accompagnée d’une attestation sur l’honneur signée du conjoint confirmant le choix de ce statut ;

b) La déclaration modificative portant mention que le conjoint du chef d’entreprise qui exerce une activité professionnelle régulière dans l’entreprise change de statut pour l’exercice de cette activité, accompagnée d’une attestation sur l’honneur signée du conjoint confirmant le choix de ce nouveau statut ;

c) La déclaration modificative portant mention que le conjoint du chef d’entreprise cesse de remplir les conditions prévues au I de l’article L. 121-4.

Le format de l’attestation sur l’honneur mentionnée au présent article et les mentions qu’elle contient sont déterminés par arrêté des ministres chargés de l’économie, de la justice et des affaires sociales.
