Chapter I: Definition and status.

A collaborating spouse is considered to be the spouse of the head of a commercial, craft or liberal profession business who carries out a regular professional activity in the business without receiving remuneration and without having the status of partner within the meaning of the article 1832 of the Civil Code.

With a view to the application of article L. 121-4, spouses who work outside the company in an employed capacity for at least half the legal working time, or in a self-employed capacity, are presumed not to be working in the company on a regular basis.

The provisions of this chapter shall also apply to the partner of the company manager who is bound to the latter by a civil solidarity pact.
