Article R1221-12 of the French General Code of Local Authorities

In application of article L. 1221-3, any public or private body, of any nature whatsoever, wishing to provide training for local elected representatives provided for in articles L. 2123-12, L. 3123-10 ou L. 4135-10 is required to obtain prior approval from the Minister responsible for local authorities, after obtaining the opinion of the national council for the training of local elected representatives. This approval is granted in the light of the guarantees provided by the body regarding the regularity of its governance and management and its ability to organise quality training courses that comply with the directory of training courses linked to the exercise of the mandate.

Training courses linked to the exercise of the mandate of local elected representative, within the meaning of this code, are training courses that comply with this directory provided by a training body that holds approval.

Article R1221-12

En application de l’article L. 1221-3, tout organisme public ou privé, de quelque nature qu’il soit, désirant dispenser une formation destinée à des élus locaux prévue aux articles L. 2123-12, L. 3123-10 ou L. 4135-10 est tenu d’obtenir un agrément préalable du ministre chargé des collectivités territoriales pris après avis du conseil national de la formation des élus locaux. Cet agrément est délivré au regard des garanties apportées par l’organisme sur la régularité de sa gouvernance et de sa gestion et sur sa capacité à organiser des formations de qualité, conformes au répertoire des formations liées à l’exercice du mandat.

Les formations liées à l’exercice du mandat d’élu local, au sens du présent code, sont les formations conformes à ce répertoire dispensées par un organisme de formation titulaire de l’agrément.
