The pre-employment declaration is made electronically.
If electronic means are not available, the declaration is made using a form laid down by order of the ministers responsible for labour and social security and, where the declaration concerns an employee covered by the agricultural social protection scheme, by the minister responsible for agriculture.
The employer sends this form, signed by him, to the body mentioned in article R. 1221-3 by fax or by registered letter with acknowledgement of receipt.
When it is sent by fax, the employer keeps the acknowledgement of receipt issued by the device and the document it has transmitted until receipt of the document provided for in article R. 1221-7.
When it is sent by registered letter with acknowledgement of receipt, this is sent no later than the last working day prior to recruitment, as evidenced by the postmark. The employer retains a copy of the letter and the postal receipt until receipt of the document provided for in article R. 1221-7.
The unavailability of one of the above-mentioned means of transmission does not release the employer from his obligation to declare by one of the other means.
