I. – The function of taking charge of the collection involves selecting the donor and monitoring the collection process.
This function is carried out by staff authorised by the Etablissement Français du Sang or the Armed Forces Blood Transfusion Centre, on the basis of their training, experience and the requirements of good transfusion practice mentioned in article L. 1222-12.
II – Supervision of the sampling process is carried out by :
1° Doctors who have the authorisation provided for in I.
2° In the absence of a doctor on the collection site, persons who satisfy the conditions for practising the profession of nurse, provided that they :
a) can provide evidence of the equivalent of two years’ experience in blood collection, supervision or care coordination ;
b) Have undergone specific training relating to the supervision of the sampling process;
c) Have access to a means of communication enabling them to contact at any time a doctor who has been granted the authorisation provided for in 1°. The terms and conditions for the application of this paragraph are laid down by order of the Minister for Health.
III. – The pre-donation interview mentioned in article R. 1221-5 is conducted by :
1° Doctors who have been granted the authorisation provided for in I ;
2° Persons who satisfy the conditions for practising the profession of nurse, provided that they have been granted the authorisation provided for in I ;
3° Medical students who have completed the second year of the second cycle of medical studies and who benefit from the authorisation provided for in I.
IV. – When, during a pre-donation interview, a risk of contra-indication as provided for by the decree setting the selection criteria for blood donors mentioned in article R. 1221-5, the assessment of which is the sole responsibility of a doctor, the nurse or medical student mentioned in 2° and 3° of III respectively, who carries out this interview in application of III of this article, calls upon a doctor who has been granted the authorisation provided for in I, present at the blood collection site or remotely, by any of the means of communication mentioned in 2° of II.
When a reason for contra-indication to donation is not understood by the prospective donor or when the prospective donor so requests, the nurse or medical student mentioned in 2° and 3° of III respectively, who carries out the pre-donation interview in application of III of this article, calls upon a doctor with the authorisation provided for in I, present at the collection site or remotely, by any of the means of communication mentioned in 2° of II. The interview takes place directly between the donor and the doctor.
