Any person subject to registration in the Trade and Companies Register shall make the declaration provided for in Article L. 123-29 with the competent territorial chamber of commerce and industry.
Any person subject to registration in the National Register of Companies as a business in the trades and crafts sector shall make this declaration to the competent regional chamber of trades and crafts even though they would be registered in the Trade and Companies Register.
Any person carrying on a commercial or craft activity who is not subject to registration in a legal publicity register makes this declaration with the territorial chamber of commerce and industry or the regional chamber of trades and crafts competent in respect of their main activity.
The persons mentioned in the first three paragraphs shall send their declaration to the chamber of commerce and industry or the regional chamber of trade and craft dependent on either the municipality where the body with which they have elected domicile is located under the conditions provided for in Article L. 264-1 of the Code de l’action sociale et des familles, or the commune where their domicile or residence is located in the case of a natural person, or their registered office in the case of a legal entity. If the domicile, residence or registered office is located in a Member State of the European Union other than France, the declaration is sent to the Chamber of Commerce and Industry or the Regional Chamber of Trades and Crafts for the municipality in which the person intends to carry out their main activity or itinerant profession. The declaration may be made at the same time as the business start-up declaration is filed with the single body mentioned in article R. 123-1.
The list of documents to be produced in support of the declaration is set by order of the minister responsible for trade.
