Article R123-304 of the French Commercial code

When the President of the Regional Chamber of Trades and Crafts or, by delegation, the President of the Departmental Chamber of Trades and Crafts is informed by an administrative or judicial authority that a registered person no longer meets the conditions for registration in the National Register of Companies as a business in the trades and crafts sector, it gives formal notice, by registered letter with acknowledgement of receipt, to the registered person or, where applicable, their heirs or successors, to regularise their situation within a period of three months. If the situation has not been regularised by the end of this period, it shall request the keeper of the National Register of Companies, through the intermediary of the single body mentioned in article R. 123-1, to remove this entry.

Lorsque le président de la chambre de métiers et de l’artisanat de région ou, par délégation, le président de la chambre de métiers et de l’artisanat de niveau départemental est informé par une autorité administrative ou judiciaire de ce qu’une personne immatriculée ne remplit plus les conditions d’immatriculation au Registre national des entreprises en tant qu’entreprise du secteur des métiers et de l’artisanat, il met en demeure, par lettre recommandée avec demande d’avis de réception, la personne immatriculée, ou, le cas échéant, ses héritiers ou ayants droit, de régulariser sa situation dans le délai de trois mois. A défaut de régularisation à l’expiration de ce délai, il sollicite du teneur du Registre national des entreprises, par l’intermédiaire de l’organisme unique mentionné à l’article R. 123-1, la suppression de cette mention.
