Article R123-305 of the French Commercial code

When the person registered in the National Register of Companies as a business in the trades and crafts sector does not comply with its obligations in terms of professional qualification or when it does not transmit the information provided for in 3° of article R. 123-279 within the required timeframe, or when, in the event of a change in situation affecting its obligations in terms of professional qualification, it does not transmit the information provided for in 2° and 3° of article R. 123-280 within the required deadlines, the President of the regional Chamber of Trades and Crafts or, by delegation, the President of the departmental level Chamber of Trades and Crafts shall request the keeper of the National Register of Companies, via the single body mentioned in Article R. 123-1, to discontinue the activities for which these obligations are not fulfilled.

Lorsque la personne immatriculée au Registre national des entreprises en tant qu’entreprise du secteur des métiers et de l’artisanat ne respecte pas ses obligations en matière de qualification professionnelle ou lorsqu’elle ne transmet pas les éléments prévus au 3° de l’article R. 123-279 dans les délais requis, ou lorsque, en cas de changement de situation affectant ses obligations en matière de qualification professionnelle, elle ne transmet pas les éléments prévus aux 2° et 3° de l’article R. 123-280 dans les délais requis, le président de la chambre de métiers et de l’artisanat de région ou, par délégation, le président de la chambre de métiers et de l’artisanat de niveau départemental sollicite du teneur du Registre national des entreprises, par l’intermédiaire de l’organisme unique mentionné à l’article R. 123-1, la suppression des activités pour lesquelles ces obligations ne sont pas remplies.
