Article R123-317 of the French Commercial code

The keeper of the National Register of Companies, informed by any administrative or judicial authority via the single body mentioned in Article R. 123-1 and under the conditions provided for in Article R. 123-7, shall proceed with the deregistration of any natural person whose declared data has not been submitted for validation by an authority mentioned in sub-section 2 of this section, where registration has been obtained on the basis of a usurped identity or one that proves to be false.

The keeper of the National Register of Companies shall proceed with the deregistration of the same natural persons and under the same conditions when informed, by the social security bodies to which these persons belong, of a definitive decision refusing affiliation or deregistration from the schemes for self-employed workers.
It deregisters the same natural persons under the same conditions when it is informed, by the social security bodies to which these persons belong, of a final decision to refuse affiliation to or deregistration from the schemes for self-employed workers provided for in article L. 611-1 of the Social Security Code and in article L. 731-1 of the rural and maritime fishing code.

Article R123-317

Le teneur du Registre national des entreprises, informé par toute autorité administrative ou judiciaire par l’intermédiaire de l’organisme unique mentionné à l’article R. 123-1 et dans les conditions prévues à l’article R. 123-7, procède à la radiation de toute personne physique dont les données déclarées n’ont pas été soumises à la validation d’une autorité mentionnée à la sous-section 2 de la présente section, dès lors que l’immatriculation a été obtenue sur le fondement d’une identité usurpée ou qui s’avère être fausse.

Il procède à la radiation des mêmes personnes physiques et selon les mêmes conditions, lorsqu’il est informé, par les organismes sociaux dont ces personnes relèvent, d’une décision définitive de refus d’affiliation ou de radiation des régimes des travailleurs indépendants prévus à l’article L. 611-1 du code de la sécurité sociale et à l’article L. 731-1 du code rural et de la pêche maritime.
