Article R123-42 of the French Commercial code

The information provided for in Article R. 123-38 shall be declared in the application for secondary registration.

This application also states the trader’s surname, usual name, pseudonym and first names, as well as the information provided for in 1° and 2° of Article R. 123-237.

The application shall state, where applicable, that the person concerned has assigned to his professional activity, pursuant to article L. 526-6, an asset separate from his personal assets, specifying the name used to carry on the activity to which the asset is assigned and the place where he has made the declaration of assignment of the asset.

Sont déclarés dans la demande d’immatriculation secondaire les renseignements prévus à l’article R. 123-38.

Cette demande rappelle en outre les nom, nom d’usage, pseudonyme et prénoms du commerçant, ainsi que les renseignements prévus aux 1° et 2° de l’article R. 123-237.

La demande rappelle, le cas échéant, que l’intéressé a affecté à son activité professionnelle, en application de l’article L. 526-6, un patrimoine séparé de son patrimoine personnel, en précisant la dénomination utilisée pour l’exercice de l’activité à laquelle le patrimoine est affecté et le lieu où il a effectué la déclaration d’affectation du patrimoine.
