I.-The administrative social committee exercises the powers provided for:
1° In articles 47 to 52 and the third paragraph of article 54 of the aforementioned decree of 20 November 2020;
2° In articles L. 2312-1 to L. 2312-84 of the Labour Code, with the exception of articles L. 2312-5 to L. 2312-7, L. 2312-9 to L. 2312-14, the fourth to sixth paragraphs of article L. 2312-15, articles L. 2312-16 to L. 2312-36, from 3° to 5° of article L. 2312-37 and articles L. 2312-40 to L. 2312-69 and L. 2312-72 to L. 2312-77.
It manages the social and cultural activities budget and its operating budget in compliance with the rules set by articles L. 2312-78, L. 2312-80 and L. 2315-64 to L. 2315-77 of the Labour Code.
The powers of the administrative social committee on matters of health, safety and working conditions are exercised under the conditions provided for in articles 76 to 78 of the above-mentioned decree of 20 November 2020.
II.-The committee mandates either the general manager of the public establishment or his representative, or a staff representative who sits on the committee to represent it and take legal action on matters within its remit.
III.The social committee of the administration is also consulted, under the conditions set out in Book IV of Part Two of the Labour Code, on the proposed redundancy, retirement or contractual termination of the employment contract of a staff representative who is an employee under private law and a member of this committee elected by the college provided for in 2° of B of II of article L. 1233-5. The opinion is expressed by secret ballot.
