The Agence nationale de la cohésion des territoires is placed under the supervision of the ministers responsible for regional planning, local authorities and urban policy. .
The Agency may, at their request, provide assistance to overseas collectivities governed by Article 74 of the Constitution and to New Caledonia, under conditions defined by agreement.
The agency shall assist the regional prefect and the departmental prefect in implementing the actions mentioned in V of Article 36 and in the second paragraph of article 41 of decree no. 2004-374 of 29 April 2004 relating to the powers of prefects, the organisation and action of State services in the regions and departments, with regard to the territorial impact of projects to transform public services.
As part of its monitoring and alert role, the agency implements: 1° Observation of urban policy and regional planning policy; > 2° Forward-looking and strategic thinking for territories, particularly in terms of digital, ecological and demographic transition, economic change and cross-border cooperation. It contributes to the implementation of public policy innovation and experimentation schemes.
The Board of Directors is made up of thirty-three members with voting rights. With the exception of members of parliament and staff representatives, the members of the Board of Directors are appointed by order of the Minister responsible for regional planning and, in the case of State representatives, on the proposal of the minister they represent. The term of office of the Chairman of the Board of Directors is three years. This term of office may be renewed once. The age limit applicable to him/her is set at seventy-five years. The Board of Directors elects, under the same conditions and for the same term as the Chairman, a Vice-Chairman who exercises all the prerogatives of the Chairman in the event of the latter’s absence or incapacity.
