Article R1233-9 of the French General Code of Local Authorities

I.-The mandate of a staff representative ends for the reasons and under the conditions provided for:

1° In the first paragraph of the Article 22 of Decree no. 2020-1427 of 20 November 2020 relating to administrative social committees in State administrations and public establishments, when it has been elected by the college mentioned in 1° of B of II of Article L. 1233-5 ;

2° In the sixth paragraph of article L. 2314-33 of the Labour Code, where it has been elected by the college mentioned in 2° of B of II of Article L. 1233-5 of this code.

II.-The staff representative whose term of office has ended in application of I is replaced under the conditions defined in the second to sixth paragraphs of Article 22 of the aforementioned Decree of 20 November 2020.

III.-In the event of renewal of the social committee during the term of office, the staff representatives are elected or appointed for the remainder of the term of office until the next general renewal.

I.-Le mandat d’un représentant du personnel prend fin pour les motifs et dans les conditions prévus :

1° Au premier alinéa de l’article 22 du décret n° 2020-1427 du 20 novembre 2020 relatif aux comités sociaux d’administration dans les administrations et les établissements publics de l’Etat, lorsqu’il a été élu par le collège mentionné au 1° du B du II de l’article L. 1233-5 ;

2° Au sixième alinéa de l’article L. 2314-33 du code du travail, lorsqu’il a été élu par le collège mentionné au 2° du B du II de l’article L. 1233-5 du présent code.

II.-Le représentant du personnel dont le mandat a pris fin en application du I est remplacé dans les conditions définies aux deuxième à sixième alinéas de l’article 22 du décret du 20 novembre 2020 mentionné ci-dessus.

III.-En cas de renouvellement du comité social d’administration en cours de mandat, les représentants du personnel sont élus ou désignés pour la durée du mandat restant à courir jusqu’au prochain renouvellement général.
