Article R1233-4 of the French Public Health Code

The authorisation may be suspended or withdrawn in whole or in part, in the cases and under the conditions set out in Article L. 1245-1, by the Director General of the Regional Health Agency, following a reasoned opinion from the Director General of the Agence de la biomédecine.

In the event of an emergency as provided for in the second paragraph of Article L. 1245-1, the temporary suspension of the authorisation may take place without the prior opinion of the Director General of the Agence de la biomédecine; the latter will be informed of the decision immediately.

The Minister for Health is immediately informed of any withdrawal or suspension of authorisation.

L’autorisation peut être suspendue ou retirée en tout ou partie, dans les cas et conditions prévus à l’article L. 1245-1, par le directeur général de l’agence régionale de santé, après avis motivé du directeur général de l’agence de la biomédecine.

Dans le cas d’urgence prévu au deuxième alinéa de l’article L. 1245-1, la suspension provisoire de l’autorisation peut intervenir sans avis préalable du directeur général de l’agence de la biomédecine ; celui-ci est immédiatement tenu informé de la décision.

Tout retrait ou suspension d’autorisation est immédiatement porté à la connaissance du ministre chargé de la santé.
