Article R1233-8 of the French Public Health Code

To be authorised to carry out organ removal from a living person, health establishments must :

1° Demonstrate that their organisation and operating conditions allow for the satisfactory performance of organ retrieval operations;

2° Have an intensive care unit on site;

3° Have the medical staff and other personnel required to carry out the sampling activity;

4° It must have the premises, and at least one operating theatre, equipped with the equipment required to carry out surgical sampling procedures.

Pour être autorisés à effectuer des prélèvements d’organes sur une personne vivante, les établissements de santé doivent :

1° Justifier d’une organisation et de conditions de fonctionnement permettant l’exécution satisfaisante des opérations de prélèvement ;

2° Disposer sur le site d’un service de réanimation ;

3° Disposer du personnel médical et des autres personnels nécessaires à l’exercice de l’activité de prélèvement ;

4° Disposer des locaux, et au moins d’une salle d’opération, dotés du matériel nécessaire à l’exécution des actes chirurgicaux de prélèvement.
