Article R1235-8 of the French Labour Code

The court will rule on the objection regardless of the amount of benefit claimed. The court’s ruling replaces the constraint issued by Pôle emploi.

The court’s decision may be appealed if the amount of the claim exceeds its final jurisdiction.

Where it is subject to appeal, the court’s decision, ruling on the opposition, is enforceable de jure on a provisional basis.

Le tribunal judiciaire statue sur l’opposition quel que soit le montant des allocations dont le remboursement a été réclamé. Le jugement du tribunal se substitue à la contrainte délivrée par Pôle emploi.


Le tribunal statue à charge d’appel lorsque le montant de la demande excède le taux de sa compétence en dernier ressort.


Lorsqu’elle est susceptible d’appel, la décision de la juridiction, statuant sur l’opposition, est exécutoire de droit à titre provisoire.
