Article R1241-9 of the French Public Health Code

When the removal of haematopoietic cells collected from bone marrow or peripheral blood is envisaged from a minor under the conditions defined in article L. 1241-3, the information provided for in article R. 1241-3 is given to each of the persons exercising parental authority or, where applicable, to the minor’s guardian by the practitioner who indicated the need for the transplant or by any other practitioner of his choice. Appropriate information is given to minors capable of discernment.

Lorsqu’un prélèvement de cellules hématopoïétiques recueillies par prélèvement dans la moelle osseuse ou dans le sang périphérique est envisagé sur la personne d’un mineur dans les conditions définies à l’article L. 1241-3, l’information prévue à l’article R. 1241-3 est délivrée à chacune des personnes investies de l’exercice de l’autorité parentale ou le cas échéant au tuteur du mineur par le praticien qui a posé l’indication de greffe ou par tout autre praticien de son choix. Une information appropriée est délivrée au mineur capable de discernement.
