Transfers carried out by an organisation in the following cases are not considered to be transfers within the meaning of this sub-section:
1° The organisation carries out research in collaboration with one or more other organisations under a contract which provides that these partners may only use the tissues, cells and their derivatives to carry out the research described in this contract and which determines the fate of the samples at the end of this research;
2° The organisation uses the services or material or technical resources of another organisation under a contract which stipulates that the latter may not carry out any operations on the tissues, cells and their derivatives other than those for which it is responsible and that it is obliged to return the remaining elements at the end of the service thus provided. The contracting parties may, however, agree to the destruction of the samples by the organisation providing the service at the end of the operations.
