Article R1251-14 of the French Labour Code

For each of its establishments, the temporary work agency is in possession of a guarantee certificate issued by the guarantor.

The certificate indicates in particular the name and address of the guarantor, the amount, the effective date and the expiry date of the guarantee granted.

The certificate is made available to the Labour Inspectorate and to the inspectors of the social security bodies and social institutions mentioned in article L. 1251-49.

Within ten days of obtaining or renewing the financial guarantee, the temporary employment agency sends a copy of this certificate to the regional directorate for companies, competition, consumption, labour and employment and to the social security bodies and social institutions responsible for each of the establishments concerned.

L’entreprise de travail temporaire est en possession, pour chacun de ses établissements, d’une attestation de garantie délivrée par le garant.


L’attestation indique notamment le nom et l’adresse du garant, le montant, la date de prise d’effet et la date d’expiration de la garantie accordée.


L’attestation est tenue à la disposition de l’inspection du travail et des agents de contrôle des organismes de sécurité sociale et institutions sociales mentionnés à l’article L. 1251-49.


L’entreprise de travail temporaire adresse, dans un délai de dix jours à compter de l’obtention ou du renouvellement de la garantie financière, une copie de cette attestation à la direction régionale des entreprises, de la concurrence, de la consommation, du travail et de l’emploi ainsi qu’aux organismes de sécurité sociale et institutions sociales compétents pour chacun des établissements concernés.
