Any cooperative company or interprofessional outpatient care company referred to inarticle L. 4041-1 of the Public Health Code which intends to develop the activity of an employers’ group as provided for in article L. 1253-1 shall mention this activity in its articles of association, prior to its effective exercise, as well as the joint and several liability of the members for the resulting debts towards the employees and the bodies responsible for compulsory contributions.
However, where the grouping of employers is formed for the benefit of only some of the members of the interprofessional outpatient care company, the company’s articles of association provide that only these members are jointly and severally liable for payment of the grouping’s debts to employees and creditor bodies.
