Article R1261-20 of the French Public Health Code

I.-When they consider that they are in a conflict of interest situation, Committee members shall inform the Chairman and refrain from sitting.

II.-The duties of Committee members are performed free of charge. They give entitlement to travel and subsistence allowances under the conditions laid down in the regulations applicable to civil servants.

III.The Chairman of the Ethics, Science and Teaching Committee is appointed from among its members in accordance with the procedures laid down in the Articles of Association of the host institution.

The position of Chairman of the Ethics, Science and Teaching Committee is incompatible with that of Head of the host institution.

IV-The Articles of Association of the host institution determine the operating procedures of the Ethics, Science and Teaching Committee.

They are adopted by the Council of the host training and research unit and approved by the Board of Directors or by the bodies acting in its stead.

I.-Lorsqu’ils estiment se trouver dans une situation de conflit d’intérêts, les membres du comité l’indiquent au président et s’abstiennent de siéger.

II.-Les fonctions de membre du comité sont exercées à titre gracieux. Elles ouvrent droit aux indemnités pour frais de déplacement et de séjour dans les conditions prévues par la réglementation applicable aux fonctionnaires de l’Etat.

III.-Le président du comité d’éthique, scientifique et pédagogique est désigné parmi ses membres selon des modalités prévues par les statuts de la structure d’accueil des corps.

La fonction de président du comité d’éthique, scientifique et pédagogique est incompatible avec celle de responsable de la structure d’accueil des corps.

IV.-Les statuts de la structure d’accueil des corps déterminent les modalités de fonctionnement du comité d’éthique, scientifique et pédagogique.

Ils sont adoptés par le conseil de l’unité de formation et de recherche de rattachement et approuvés par le conseil d’administration ou par les organes en tenant lieu.
