Article R1263-11-1 of the French Labour Code

The Labour Inspectorate monitoring officer referred to in Articles L. 8112-1 or L. 8112-5 who observes one of the breaches referred to in Article L. 1263-3 shall issue a written injunction to the employer established outside France who posts employees on national territory to put an end to this breach within a period of three days from receipt of the injunction. This period may be reduced in exceptional circumstances, but may not be less than one day.

The injunction is addressed to the employer or, where applicable, to the employer’s representative referred to in II of Article L. 1262-2-1.

L’agent de contrôle de l’inspection du travail mentionné aux articles L. 8112-1 ou L. 8112-5 qui constate l’un des manquements mentionnés à l’article L. 1263-3 enjoint par écrit à l’employeur établi hors de France qui détache des salariés sur le territoire national de faire cesser ce manquement dans un délai de trois jours, à compter de la réception de l’injonction. Ce délai peut être réduit en cas de circonstances exceptionnelles, sans qu’il puisse être inférieur à un jour.


L’injonction est adressée à l’employeur ou, le cas échéant, au représentant de l’employeur mentionné au II de l’article L. 1262-2-1.
