The decisions referred to in Article 103-1 of Decree no. 85-1388 of 27 December 1985 on the reorganisation and judicial liquidation of companies are forwarded by the Banque de France to each banker who has reported cheque payment incidents, within two working days of their notification to the Banque de France.
In the event of suspension of the effects of a cheque-writing ban, the drawee shall forward to the Banque de France, no later than the second working day following receipt of the court’s decision, the requests for cancellation of each of the declarations of cheque payment incidents referred to in that decision.
In the event of the plan being wound up pursuant to Article L. 621-82 of the French Commercial Code, the drawee shall, within the same timeframe, re-register the payment incidents for which it has requested cancellation under the conditions set out in the second paragraph above, in accordance with the procedures set out in Article R. 131-12 of this Code. It forwards the new declarations of each of these incidents to the Banque de France. The cheque-writing ban takes effect from its initial date.
