Article R1312-7 of the French Public Health Code

In the event of a change of assignment outside the territorial jurisdiction of the authorising authority, the authorisation lapses. A new authorisation may, if necessary, be issued under the conditions set out in articles R. 1312-2 to R. 1312-4.

If the authorised agent has already been sworn in, in any capacity whatsoever, to record offences, he or she does not have to take the oath again. Upon justification, the clerk of the judicial court within whose jurisdiction the official’s administrative residence is located shall record this oath-taking on the official’s professional card or, failing this, on the official’s authorisation order.

En cas de changement d’affectation en dehors du ressort de compétence territoriale de l’autorité d’habilitation, l’habilitation est caduque. Une nouvelle habilitation peut, le cas échéant, être délivrée dans les conditions prévues aux articles R. 1312-2 à R. 1312-4.

Lorsque l’agent habilité a déjà été assermenté, à quelque titre que ce soit, pour constater des infractions, il n’a pas à renouveler sa prestation de serment. Sur justification, le greffier du tribunal judiciaire dans le ressort duquel se trouve sa résidence administrative enregistre cette prestation de serment sur la carte professionnelle ou à défaut sur l’arrêté d’habilitation de l’agent.
