Article R1313-23 of the French Public Health Code

The Chief Executive is assisted by directors according to the organisation of the agency, including a Deputy Chief Executive who deputises for the Chief Executive in the event of vacancy, absence or incapacity.

The Managing Director may delegate his signature to staff under his authority.

He may delegate some of his powers to staff appointed to exercise administrative or scientific responsibilities in the establishment or in a unit shared with other organisations, with the exception of the opinions and recommendations mentioned in article R. 1313-21 and the decisions mentioned in article R. 1313-22.

However, he may delegate his powers to the Director of the Agence nationale du médicament vétérinaire to take the decisions mentioned in article R. 1313-22.

Staff benefiting from a delegation of powers may delegate their signature.

The delegations of authority mentioned in the third and fourth paragraphs are published in the Journal officiel de la République française.

Article R1313-23

Le directeur général est assisté de directeurs selon l’organisation de l’agence dont un directeur général adjoint qui le supplée en cas de vacance, d’absence ou d’empêchement.

Le directeur général peut déléguer sa signature aux personnels placés sous son autorité.

Il peut déléguer à des agents désignés pour exercer des fonctions de responsabilité administrative ou scientifique dans l’établissement ou dans une unité commune avec d’autres organismes une partie de ses pouvoirs, à l’exception des avis et recommandations mentionnés à l’article R. 1313-21 et des décisions mentionnées à l’article R. 1313-22.

Toutefois, il peut déléguer au directeur de l’Agence nationale du médicament vétérinaire ses pouvoirs pour prendre les décisions mentionnées à l’article R. 1313-22.

Les personnels bénéficiant d’une délégation de pouvoir peuvent déléguer leur signature.

Les délégations de pouvoir mentionnées aux troisième et quatrième alinéas font l’objet d’une publication au Journal officiel de la République française.
