The analyses of water samples carried out during the health checks provided for in article R. 1322-40 and their performance characteristics are defined by an order of the Minister for Health, issued after consultation with the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail.
They are carried out by a laboratory which must obtain prior approval from the Director General of the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail and, for radioactivity analyses, from the Minister for Health. This approval may be granted to laboratories based in another Member State of the European Union which can demonstrate that they have equivalent resources and use equivalent methods. An order of the Minister for Health, issued after consultation with the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail, lays down the administrative and technical conditions for approval of these laboratories, relating in particular to their human and material resources and the analysis methods used.
If the application for approval is kept silent for more than six months, this will be deemed to constitute a decision of acceptance.
