Monitoring is the responsibility of the operator and includes any operation to check compliance with the legislative and regulatory provisions relating to the water in question.
Health inspections are carried out by the Director General of the Regional Health Agency. It includes any of the checks mentioned in article R. 1321-15.
Verification of the quality of natural mineral water is carried out according to an analysis programme including the health monitoring and control operations provided for in articles R. 1322-9, R. 1322-39 and R. 1322-40. The programme of analyses for monitoring natural mineral water includes a main part defined in article R. 1322-41 and an additional part defined by the operator according to the hazards identified in application of the provisions of article R. 1322-29.
Samples and analyses for the main part of the monitoring of natural mineral waters are carried out by a laboratory that meets the requirements defined by order of the Minister for Health. These samples and analyses are carried out by the laboratory located in the water conditioning plant or in the spa establishment or, failing this, by a laboratory accredited by the French Accreditation Committee or by any other accreditation…
The operator shall immediately inform the Director General of the Regional Health Agency, who will immediately inform the Prefect, of any incident that may have consequences for public health, particularly concerning the water resource and the way it is developed, the conditions under which the water is transported and stored up to the points of use, and the measures taken to remedy the situation.
The verification of water quality carried out by the Regional Health Agency, as part of the provisions of article R. 1322-40, includes an analysis programme for the sanitary control of natural mineral water. In order to carry out this programme, water samples are taken by the agency’s departments or by the staff of a laboratory approved under the conditions mentioned in article R. 1322-44-3.
The analyses of water samples carried out during the health checks provided for in article R. 1322-40 and their performance characteristics are defined by an order of the Minister for Health, issued after consultation with the Agence nationale de sécurité sanitaire de l’alimentation, de l’environnement et du travail. The approved laboratories send the results of their analyses to the operator and to the Director General of the Regional Health Agency, who informs the Prefect as necessary.
