When it is planned to use the water for therapeutic purposes in a spa establishment or when the applicant wishes to demonstrate the health benefits of water intended for packaging or distribution in public refreshment areas, and subject to the favourable opinion of the Departmental Council for the Environment and Health and Technological Risks on the application for authorisation to exploit the mineral water source, the dossier mentioned in article R. 1322-5 is supplemented by clinical and therapeutic studies.
The Prefect forwards a copy of the application to the Minister for Health, who refers the matter to the National Academy of Medicine for its opinion.
The Académie nationale de médecine gives its opinion within four months of receiving the application. The Minister for Health immediately sends his opinion to the Prefect and the Director General of the Health Agency. In the absence of an opinion within four months, the opinion is deemed to be unfavourable.
In the case of a revision of the authorisation to operate, the opinion of the Académie nationale de médecine is not required if the characteristics of the mineral water are unchanged compared to the authorisation to operate in force.
