Article R133-41 of the French Tourism Code

Any public establishment for inter-municipal cooperation may apply for classification as a tourist resort, for one, several or all of its member municipalities, with the exception of those municipalities which are responsible for promoting tourism, including the creation of tourist offices, in accordance with the provisions of articles L. 5214-16 and L. 5216-5 of the General Local Authorities Code.

The decision of the governing body of the public inter-municipal cooperation body defines the boundaries of the area for which classification is requested.

A plan is appended to the decision if only part of a commune is included in the request for classification.

For the application of the provisions of this sub-section, the deliberative body of the public establishment for inter-municipal cooperation is substituted for the municipal council and the president of the public establishment for inter-municipal cooperation is substituted for the mayor.

Tout établissement public de coopération intercommunale peut demander le classement en station de tourisme, pour une, plusieurs ou l’ensemble de ses communes membres à l’exception des communes qui exercent la compétence de promotion du tourisme, dont la création d’offices de tourisme en application des dispositions des articles L. 5214-16 et L. 5216-5 du code général des collectivités territoriales.

La délibération de l’organe délibérant de l’établissement public de coopération intercommunale délimite le territoire faisant l’objet de la demande de classement.

Un plan lui est annexé lorsque seule une fraction de commune fait partie de la demande de classement.

Pour l’application des dispositions de la présente sous-section, l’organe délibérant de l’établissement public de coopération intercommunale est substitué au conseil municipal et le président de l’établissement public de coopération intercommunale est substitué au maire.
