Failure to comply with the health and hygiene rules laid down in this section constitutes offences which are investigated and recorded in accordance with article L. 1312-1 and punished in accordance with article R. 1312-14.
It may also, depending on the nature of the rules disregarded, their importance or their accumulation, and having regard to the possible risk or danger resulting therefrom, constitute :
1° an emergency situation justifying the immediate implementation of health measures, in accordance with article L. 1311-4;
2° or an insalubrious situation among those defined in articles L. 1331-22 and L. 1331-23, falling under the State representative’s authority to police the health of buildings, premises and installations as provided for in 2° of the Article L. 511-4 of the French Construction and Housing Code and Articles 9 and 10 of Act 2011-725 of 23 June 2011 containing special provisions relating to informal housing districts and the fight against substandard housing in overseas departments and regions;
3° or one or more disorders that do not constitute a danger or risk to people’s health, but which need to be remedied for health or hygiene reasons, falling under the administrative police powers of the mayor pursuant toarticle L. 1421-4 of this Code andarticle L. 2212-2 of the General Code for Local Authorities.
