Article R1333-140 of the French Public Health Code

When a nuclear activity has not begun within three years of the issue of the receipt for the declaration or notification of the registration or authorisation, the declaration, registration or authorisation lapses.

In the event of definitive withdrawal of the registration or authorisation issued in application of the third paragraph of Article L. 1333-31, the Nuclear Safety Authority shall prescribe to the person responsible for the nuclear activity the conditions under which current or future radioactive sources and radioactive waste are to be disposed of at his/her expense.

Lorsqu’une activité nucléaire n’a pas commencé à être exercée dans un délai de trois ans après la délivrance du récépissé de la déclaration ou la notification de l’enregistrement ou de l’autorisation, la déclaration, l’enregistrement ou l’autorisation sont caducs.

En cas de retrait définitif de l’enregistrement ou de l’autorisation prononcé en application du troisième alinéa de l’article L. 1333-31, l’Autorité de sûreté nucléaire prescrit au responsable de l’activité nucléaire les conditions d’élimination à ses frais des sources radioactives et des déchets radioactifs actuels ou futurs.
