I.-Without prejudice to Article L. 1252-1 of the Transport Code and subject to the provisions of Article L. 1333-9, the transport of radioactive substances within France is subject to a declaration, registration or authorisation by the Nuclear Safety Authority.
A decision by the Nuclear Safety Authority, approved by order of the ministers responsible for nuclear safety and transport and, where the decision concerns protection against malicious acts, by the Minister for Energy for transport not under the responsibility of the Minister for Defence, sets out in particular:
1° The characteristics of radioactive substances whose transport is subject to authorisation, registration or declaration;
2° The conditions for exemption;
3° The composition of the application for authorisation or registration and the information attached to the declaration;
4° Terms and conditions of investigation;
5° Conditions for renewal, withdrawal and suspension.
If the Nuclear Safety Authority remains silent for more than six months on an application for registration or authorisation, this is deemed to constitute registration for the transport of radioactive substances or a decision to reject the application for authorisation for the transport of radioactive substances.
Exempted are shipments entering territorial waters but not calling at a French port, and air shipments not calling at a French airport.
II – Authorisations for the transport of radioactive substances by air issued pursuant to Article R. 330-1-1 of the Civil Aviation Code take the place of the authorisation provided for in this article.
III.-The transport of radioactive substances is exempt from the provisions of section 6 of this chapter.
