Pursuant to 1° of Article L. 1333-2, exemptions to the prohibitions set out in R. 1333-2 and R. 1333-3 may be granted by order of the Minister for Health and, depending on the case, the Minister for Consumer Affairs or the Minister for Construction, after obtaining the opinion of the Nuclear Safety Authority and the Haut Conseil de la santé publique, if they are justified by the benefits they provide in relation to the health risks they may present. These exemptions do not apply to foodstuffs, animal feed, materials in contact with foodstuffs and water intended for human consumption, toys, ornaments or cosmetic products.
The Minister responsible for radiation protection shall inform the other Member States of the European Union of its decisions granting a derogation in the cases provided for in Article 20 of Council Directive 2013/59/Euratom of 5 December 2013 laying down basic safety standards for health protection against the dangers arising from exposure to ionising radiation.
