Section 1: General measures for the protection of the general public against ionising radiation.

It is prohibited to import from a country outside the European Union, to export from the European Union, to distribute or to use consumer goods, foodstuffs, construction products or animal feed that do not comply with the prohibitions set out in article R. 1333-2 that apply to them.

Manufacturers, suppliers and users of consumer goods and construction products benefiting from a derogation granted in application of article R. 1333-4 are subject to the provisions of section 6 of this chapter.

I.-The use of substances originating from a facility in which a nuclear activity is or was carried out, when they are contaminated, activated or likely to be by radionuclides belonging to categories of substances defined by decree, may be subject to an exemption to the prohibitions set out in articles R. 1333-2 and R. 1333-3, provided that these substances are first recovered in a facility referred to in articles L….

When the derogation is granted, the products resulting from the recovery operation are no longer radioactive substances as defined inArticle L. 542-1-1 of the Environmental Code and no longer warrant radiation protection controls as long as they are effectively recovered under conditions that comply with those laid down in the derogation.

I.-The person in charge of a facility referred to in I of Article R. 1333-6-1 shall define the acceptance specifications for substances entering the facility and the procedures for checking compliance with these specifications. The categories of substances that may benefit from the exemptions resulting from the application of articles R. 1333-6-1 to R. 1333-6-3 are as follows: -Metallic substances which, prior to their use in a nuclear activity, did not warrant radiation protection monitoring.
