Article R1334-8 of the French Public Health Code

The report provided for inarticle L. 511-14 of the French Construction and Housing Code, drawn up in accordance with the provisions of article L. 1334-1-1, includes :

1° An inspection of the premises to check that the prescribed work has been carried out;

2° An analysis of dust taken from the floor to measure the level of contamination in the premises.

Once the work has been completed, the concentration of lead in dust on the floor, per unit area, must not exceed a threshold defined by joint order of the ministers responsible for housing and health. This order also sets out the procedures for carrying out this report.

When the competent authority has automatically carried out the measurements prescribed in accordance with the provisions of article L. 511-11 of the French Construction and Housing Code, the person required to carry out the measurements is responsible for the post-work report.

Le constat prévu par l’article L. 511-14 du code de la construction et de l’habitation, réalisé conformément aux dispositions de l’article L. 1334-1-1, comprend :

1° Une inspection des lieux permettant de vérifier la réalisation des travaux prescrits ;

2° Une analyse des poussières prélevées sur le sol permettant de mesurer le niveau de contamination des locaux.

A l’issue des travaux, la concentration en plomb des poussières au sol, par unité de surface, ne doit pas excéder un seuil défini par arrêté conjoint des ministres chargés du logement et de la santé. Cet arrêté détermine également les modalités de réalisation de ce constat.

Lorsque l’autorité compétente a exécuté d’office les mesures prescrites conformément aux dispositions de l’article L. 511-11 du code de la construction et de l’habitation, le constat après travaux est mis à la charge de la personne tenue de réaliser les mesures.
