Article R1342-1 of the French Public Health Code

Without prejudice to Article 48 of Regulation (EC) No 1272/2008 of the European Parliament and of the Council of 16 December 2008 on the classification, labelling and packaging of substances and mixtures, any advertisement, in any form whatsoever, concerning a substance classified as dangerous, a mixture classified as dangerous or containing a substance classified as dangerous under this Regulation, which enables a private individual to conclude a purchase contract without first having seen the label, must include the words “Dangerous.

The provisions of the first paragraph do not apply to:

1° Plant protection products covered by Regulation (EC) No 1107/2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market;

2° Biocidal products covered by Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products.

Article R1342-1

Sans préjudice de l’article 48 du règlement (CE) n° 1272/2008 du Parlement européen et du Conseil du 16 décembre 2008 relatif à la classification, à l’étiquetage et à l’emballage des substances et des mélanges, toute publicité, sous quelque forme que ce soit, concernant une substance classée dangereuse, un mélange classé dangereux ou contenant une substance classée dangereuse au titre de ce règlement, permettant à un particulier de conclure un contrat d’achat sans avoir vu au préalable l’étiquette, comporte la mention “ Dangereux. Respecter les précautions d’emploi ”.

Les dispositions du premier alinéa ne s’appliquent pas :

1° Aux produits phytopharmaceutiques relevant du règlement (CE) n° 1107/2009 du Parlement européen et du Conseil du 21 octobre 2009 concernant la mise sur le marché des produits phytopharmaceutiques ;

2° Aux produits biocides relevant du règlement (UE) n° 528/2012 du Parlement européen et du Conseil du 22 mai 2012 concernant la mise à disposition sur le marché et l’utilisation des produits biocides.
