Chapter II: Provisions specific to dangerous substances and mixtures

Importers and downstream users are required to inform the designated body mentioned in article R. 1342-13 of any withdrawal from the market, any change of trade name and any change in the composition or classification of mixtures for which a declaration has been made under article R. 1342-13. This information is sent within thirty days in accordance with the procedures laid down by the order mentioned in article R. 1342-15.

The declaration provided for in Article R. 1342-13 includes the following information: 1° The existing name or names of the mixture in question ; 2° The qualitative and quantitative composition of the mixture; where the mixture comprises one or more mixtures, the composition of which is not known to the declarant, the latter shall indicate the trade name and contact details of the supplier of the mixture or mixtures and…

If the importer or downstream user is unable to provide all or part of the information referred to in Article R. 1342-15 within the time allowed, he shall inform the designated body referred to in Article R. 1342-13 of the name of the natural or legal person who is able to do so.

Any person who has provided the information requested in article R. 1342-15 has a right of access to this information and, where appropriate, a right of rectification with the designated body mentioned in article R. 1342-13.

The information contained in the declaration referred to in article R. 1342-13 may only be used to respond to requests for information aimed at preventing the effects of the substances or mixtures concerned on health or ensuring the treatment of conditions induced by these substances or mixtures.
