Article R1342-18 of the French Public Health Code

The information contained in the declaration referred to in article R. 1342-13 may only be used to respond to requests for information aimed at preventing the effects of the substances or mixtures concerned on health or ensuring the treatment of conditions induced by these substances or mixtures.

The bodies responsible for toxicovigilance and the body referred to in article L. 4411-4 of the Labour Code are authorised to provide persons who so request and who can prove their capacity in the field of public health protection with the information they hold concerning the dangers posed by a substance or mixture and the precautions to be taken in its use, storage, transport and disposal, to the exclusion of any other information covered by business secrecy.

Les informations contenues dans la déclaration mentionnée à l’article R. 1342-13 ne peuvent être utilisées que pour répondre à des demandes de renseignements ayant pour but de prévenir les effets des substances ou mélanges concernés sur la santé ou d’assurer le traitement des affections induites par ces substances ou mélanges.

Les organismes chargés de la toxicovigilance et l’organisme mentionné à l’article L. 4411-4 du code du travail sont habilités à fournir aux personnes qui en font la demande et qui justifient d’une qualité dans le domaine de la protection sanitaire des populations les renseignements qu’ils détiennent au sujet des dangers que présente une substance ou un mélange et des précautions à prendre dans son emploi, son stockage, son transport et son élimination, à l’exclusion de toute autre information relevant du secret des affaires.
