Article R141-13 of the French Code governing the entry and residence of foreign nationals and the right of asylum

For the purposes of re-routing or removal, the transport of foreign nationals placed or held in a waiting area or place of detention may be the subject of a public contract awarded by the territorially competent prefect under the conditions laid down in the public procurement code. In this case, the purpose of the contract is limited to the provision of vehicles and the driving and maintenance of these vehicles, excluding the direct surveillance of foreign nationals and the implementation of any coercive measures with regard to them, which fall within the exclusive remit of national police officers and national gendarmerie military personnel.

Pour les besoins de réacheminement ou d’éloignement, le transport des étrangers placés ou maintenus en zone d’attente ou dans un lieu de rétention peut faire l’objet d’un marché public passé par le préfet territorialement compétent dans les conditions prévues par le code de la commande publique. Dans ce cas, l’objet du marché est limité à la mise à disposition de véhicules, la conduite et l’entretien de ces véhicules à l’exclusion de la surveillance directe des étrangers et de la mise en œuvre à leur égard de toute mesure à caractère coercitif, qui relèvent de la compétence exclusive des fonctionnaires de la police nationale et des militaires de la gendarmerie nationale.
